What Is Probate?

Probate is a court proceeding that legally “opens” a deceased person’s estate so that all assets titled in the decedent’s name alone, can be valued, all proper debts can be paid, and remaining assets distributed to the beneficiaries as stated in the Last Will and Testament. If the person who died did not have a Will, the assets are distributed to the beneficiaries entitled to the estate by law.
