Mediation is a process where the two parties, who are seeking to terminate their marriage, sit down with a neutral party (mediator) and they discuss all issues. It does not matter if the parties have children or not; all issues can be resolved by mediation. If the parties reach an agreement, then a mediated agreement is prepared, setting forth the global settlement. Neither party is required to have their own attorney during this process, however, it is recommended. Your mediator is merely attempting to help the two parties reach an agreement that is acceptable and reasonable to the two parties. The mediator, nor ultimately the Court will stop you from entering an agreement that is not in your best interest.
