Mediation is a process where the two parties, who are seeking to terminate their marriage, sit down with a neutral party (mediator) and they discuss all issues. It does not matter if the parties have children or not; all issues can be resolved by mediation. If the parties reach an agreement, then a mediated agreement is prepared, setting forth the global settlement. Neither party is required to have their own attorney during this process, however, it is recommended.
